These Terms of Service (“Terms”) govern your access to and use of the Service, including any websites, applications, APIs, and related support operated by Epigos. By creating an account, accessing, or using the Service, you agree to these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization and its users.

If you do not agree, do not use the Service.


1. The Service

PingChange provides tools to monitor web pages and API documentation/specifications for changes, store snapshots and diffs, deliver notifications, and provide related automation and AI-assisted features. We may modify, add, or remove features; where changes materially reduce core functionality for paying customers, we will use commercially reasonable efforts to provide advance notice (for example by email or in-product notice).

The Service is not an archival system of record, not guaranteed to capture every change with perfect fidelity, and not a substitute for legal, regulatory, or security advice.


2. Eligibility and accounts

You must be at least 16 (or the age of digital consent in your jurisdiction, if higher) and capable of entering a binding agreement. You must provide accurate registration information and keep credentials secure. You are responsible for all activity under your account.

For team or organization accounts, administrators may invite users and assign roles. Administrators are responsible for managing access and complying with these Terms.


3. Customer obligations and acceptable use

3.1 Lawful monitoring

You represent and warrant that your use of the Service—including every URL, target, and data source you configure—is lawful and permitted under applicable law, the terms of any site or API you monitor, and any contract or duty applicable to you. You will not use the Service to access, obtain, or process data you are not authorized to process.

3.2 Prohibited conduct

Without limiting the foregoing, you must not:

  • Attempt to bypass access controls, authentication, or technical limitations except through features we explicitly provide for legitimate monitoring.
  • Use the Service to harm, harass, defraud, or discriminate, or to distribute malware or unlawful content.
  • Reverse engineer the Service except where applicable law forbids this restriction.
  • Resell or scrape the Service in bulk to build a competing service, or probe our infrastructure in an abusive way.
  • Use the Service in violation of export controls, sanctions, or applicable telecommunications rules.

We may investigate violations and may suspend or terminate access where we reasonably believe a breach has occurred or is imminent.


4. Your content and configuration

Customer Data” means data you submit to the Service or that we process on your behalf in connection with your account—including monitor configurations, URLs, credentials you voluntarily supply for integrations, captured page/spec snapshots, diffs, alert settings, and similar technical data.

You retain your rights in Customer Data. You grant Epigos a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display Customer Data only as reasonably necessary to provide, secure, and improve the Service and as described in our Privacy Policy.

You are responsible for the accuracy and legality of Customer Data. Epigos does not pre-screen all Customer Data but may remove or disable access to content that violates these Terms or law.


5. AI features

Some features use artificial intelligence or machine learning to summarize changes, filter noise, or interpret configurations. AI outputs may be incomplete or incorrect. You should not rely on AI outputs as the sole basis for high-risk decisions (legal decisions, safety-critical systems, medical use, etc.) without independent verification.

You will not submit special categories of personal data (for example health data) or other sensitive information to AI features unless you have an appropriate legal basis and our documentation explicitly supports that processing.


6. Third-party services

The Service may integrate with third-party platforms (for example identity providers, notification channels, hosting, analytics, or model providers). Your use of those services may be subject to their terms. Epigos is not responsible for third-party services outside our reasonable control.


7. Fees, trials, and taxes

Paid plans, usage limits, and invoicing are described at checkout or in an order form. Unless stated otherwise, fees are non-refundable except where required by law. You are responsible for applicable taxes, duties, and banking fees. We may change pricing with reasonable notice; changes apply prospectively.


8. Intellectual property

Epigos and its licensors own the Service, software, documentation, branding, and all related intellectual property rights. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

Feedback you provide may be used by Epigos without obligation or compensation to you.


9. Confidentiality

Each party may receive non-public information of the other (“Confidential Information”). The receiving party will use reasonable care to protect Confidential Information and will use it only for purposes of these Terms. Exclusions include information that is public without breach, independently developed, or rightfully received from a third party.


10. Warranties disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EPIGOS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. EPIGOS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL CHANGES WILL BE DETECTED.


11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.
  • EPIGOS’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO EPIGOS FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED POUNDS STERLING (GBP 100) IF YOU HAVE NOT PAID FEES.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.


12. Indemnity

You will defend and indemnify Epigos and its directors, officers, employees, and affiliates against third-party claims arising from (a) your Customer Data, (b) your breach of these Terms, or (c) your violation of law or third-party rights in connection with the Service.


13. Suspension and termination

We may suspend access if we reasonably believe there is a security risk, abuse, or legal obligation. You may stop using the Service at any time. On termination, your right to access the Service ceases; we may delete Customer Data in line with our Privacy Policy and Data Deletion page.

Sections intended to survive (including intellectual property, disclaimers, limitations, indemnity, and governing law) will survive termination.


14. Government users

If you are a U.S. government entity, you acknowledge the Service is commercial computer software and your rights are limited to those in these Terms and applicable U.S. government acquisition regulations.


15. Governing law and disputes

These Terms are governed by the laws of England and Wales, excluding conflict-of-law rules. The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in the EEA or UK, you may also have mandatory protections in your country of residence.

Nothing in these Terms limits non-waivable consumer or data-protection rights.


16. Changes

We may update these Terms by posting a revised version and updating the effective date. If changes are material, we will provide reasonable notice (for example email or in-product). Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.


17. Miscellaneous

Assignment. You may not assign these Terms without our consent; we may assign in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms and any order form constitute the entire agreement regarding the Service.
Severability. If a provision is invalid, the remainder remains in effect.
No waiver. Failure to enforce a provision is not a waiver.
